Code of Conduct

Introduction

This code of conduct (“Code”) applies to all sighted helpers (“Helper(s)” or “you”) who are registered with InnoSpire Technology Limited (“WeVoice+”, “we”, “us”, or “our”); .

This Code provides guidance and sets out our expectations of Helpers when providing assistance to visually impaired users (“Users”) during a live video chat and when accessing, participating or using any of the WeVoice+ mobile application(s), service(s) and website(s) which we provide (each a “Service” and together, the “Services”).

All Helpers must comply with and abide by the Code. These are minimum standards and are by no means cover every contingency. However, any failure to comply with these standards may be sufficient grounds for disciplinary action up to and including termination of the individual from his/her position as a Helper, volunteer or otherwise.

Any Helper who is uncertain of the application of this Code should contact us for clarification or further information.

We reserve the right to change the content of this Code from time to time. The updated Helpers’ Code of Conduct will be posted on our website.

Your Commitment and Responsibilities

By registering with us as a Helper, you agree, while accessing, participating and/or using the Services, to:

Discharge your duties as a Helper with reasonable care, skill and diligence, in good faith and to the best of your abilities;

conduct yourself in a courteous and professional manner at all times;

be aware of your own language and behavior; and never use inappropriate language or behavior, or do anything that is abusive whether verbal, physical, or otherwise; and
-
attend all trainings, workshops, and/or seminars in relation to the Services as requested by us for the purposes of enabling you to provide the necessary assistance to Users during a live video chat and fulfil your role and responsibilities as a Helper.

By registering with us as a Helper, you agree, while accessing, participating and/or using the Services, not to:

violate any local, national or international law and regulation;
-
stalk, harass or harm another individual;
-
smoke or be under the influence of alcohol or other substances when providing assistance;
-
engage in activities or suggestions of a sexual nature.

collect or store personal data about other Users or Helpers;
-
impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;
-
interfere with or disrupt the Services or servers or networks connected to WeVoice+;
-
disobey any reasonable instructions, requirements, procedures, policies or regulations of WeVoice+; or
-
copy, sell, resell, exploit for any commercial purposes, any portion of WeVoice+ and the Services.

You should also refrain from asking any personal questions that are not related to accomplishing a task, as well as to refrain from meeting any User personally or contacting any User outside of a session through personal correspondence including email and/or social media.

Respect and Understanding

You should respect fundamental human rights, privacy rights, human dignity, social equality and equal rights of all Users.

You must treat with respect all Users with whom you interact with when providing assistance. In particular, you should always take into consideration the difficult experiences that Users may have faced or survived, as well as the disadvantaged position in which they may find themselves in.

You should also recognize the ethnic and cultural diversity of the Users being assisted. Be respectful and be sensitive to the culture of Users and appreciate the differences among them in respect of their ethnicity, national origin, gender, religion, custom and sexual orientation.

Harassment, discrimination or other behaviors that compromise the dignity and self-worth of others cannot be tolerated, and will be addressed promptly

Restrictions on User’s use of the Services

You should be aware that there are restrictions in place in relation to the User’s use of the Services. For a full list of actions or conduct that a User is restricted from doing, please refer to the section titled “Restrictions on Your Use of the Services” in the Terms of Use.

The User’s violations of any of these restrictions or any other provisions in the Terms of Use are not to be tolerated. However, we understand that due to the User’s visual impairment, it may be possible that the User may violate the aforementioned restrictions inadvertently when using the Services and starting a new video chat by, for example, sharing private, confidential or health information. In this case, you shall warn the User that the User has violated the restrictions, and the User is expected to stop and/or not repeat the relevant violation.
Escalation

If you encounter any emergency during a live video chat, please follow the emergency protocol and communicate the situation with our designated emergency point of contact, who will escalate the situation appropriately and contact emergency services as necessary. To provide an environment rooted in safety and respect, you are trained to let a User know you will assist with finding sighted assistance in the User’s physical environment. However, if you feel uncomfortable with the request, you may escalate the session to a supervisor.

User Confidentiality and Personal Data

At all times, the privacy and dignity of Users, Helpers and staff will be respected. You may have access to information and documents relating to Users, Helpers and staff that are private and confidential in nature; reasonable care and caution must be exercised to protect and maintain total confidentiality. You will not read records or discuss such information unless there is a legitimate purpose.

You must not encourage a User to pass on sensitive information such as that which may be found on his/her Hong Kong Identification Card or Passport.

You should not ask about the background and family situation or any personal matters of Users.
-
You should not exchange any personal contact details (eg. phone number, social networking, and email address) with a User. If a User passes such information to you, you should report this to us.

You should not take photos or screenshots of the live video chat and/or the User. You must also not publish any materials or stories about Users without permission.

Copyright

We respect the intellectual property rights of others and require that you and all of our Users and Helpers do the same. If you believe that content or other activity taking place on our site or services constitutes infringement of a work protected by copyright, please provide us with the written information specified below:

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

A description of the copyrighted work that you claim has been infringed upon;

A description of where the material that you claim is infringing is located;
-
Your address, telephone number, and email-address;
-
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
-
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Limitation of Liability

To the extent permitted under applicable law, in no event will WeVoice+ or its officers, employees, directors or affiliates be liable for any direct or indirect damages, losses, costs, expenses and fees resulting from your access to, participation or use of the WeVoice+ App or the Services.

Indemnity

You agree to indemnify, defend and hold harmless WeVoice+, its affiliates, officers, directors or employees from and against any and all third-party claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys’ fees and court costs) that such parties may incur as a result of or arising from

The content supplied by you and nay information you (or anyone accessing WeVoice+ and the Services acting as you) submit, post or transmit through WeVoice+;

Your access, participating and usage of the Services;
-
Your violation of this Code;
-
Your (or anyone using your registration/ volunteer information) violation of any rights of any other person or entity; or
-
Any viruses, Trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines input by you into the WeVoice+ app, our website or other Services.

Miscellaneous Terms and Conditions

Inappropriate behavior, including but not limited to failure to follow this Code, is a ground for disciplinary action, up to and including termination of the individual from his/her position as a Helper. Helpers who fail to adhere to any of the above may be suspended from involvement in WeVoice+ and its Services on a temporary or permanent basis.

We reserve the right to modify or vary the contents of this Code at any time. The updated Helpers’ Code of Conduct will be posted on our website. Your continuous access, participation or use of the Services after the posting of such Code will constitute your acceptance to the variation or modification as mentioned therein.
